The department provides litigation services to a broad blue-chip client base of major corporate clients, banks, financial institutions and state authorities in all areas of law.
Commercial litigation
The members of the commercial litigation team have expertise in all areas of commercial law. The firm provides advice and assistance primarily to corporate clients.
Recoveries and banking litigation
Our recoveries and banking litigation team has a highly sophisticated database with online enquiries to the deeds office countrywide and the companies and close corporations office, which enables it to determine the involvement of an individual in various corporate bodies, the credit-worthiness of corporate bodies and/or individuals as reflected by any judgments obtained. In addition to the professional legal team the department has highly skilled paralegals reporting to clients by way of an electronically generated matrix progress report.
The firm acts for a number of major banks, financial organisations and commercial concerns, who have instructed it to collect their outstanding debtor's book in a cost effective manner.
Services include:
- Evaluating and advising clients on the best methods to recover an outstanding debtors’ book
- Advising on security documentation (for example guarantees, acknowledgements of debt and suretyships)
- Recommending and advising clients of the most cost effective approach to follow, whether by letter of demand, summons, sequestration or liquidation
- Speedy follow up after judgment, either by way of debtor enquires in the relevant court, putting into place of emolument attachment orders and attaching monies owing to the defaulting debtor
- Advice on and involvement in insolvency enquiries taking place after the liquidation of a corporate body or sequestration of an individual
- All aspects of defended litigation arising from the debt recovery process
