Due to the heavily regulated environment in which oil companies are required to operate, the construction and establishment of retail sites has become more and more difficult.  

Oil companies are constantly in search of land with a view to establishing new sites. Prospective sites are often undivided portions of land and form part of townships that are yet to be proclaimed. Property legislation prohibits the acquisition of erven within unproclaimed townships or conclusion of leases on portions of land that have not been formally divided. The consequence is that our clients are unable to secure favourable sites at an early stage and before their competitors become aware of the opportunity.  

To overcome this difficulty we prepared contractual models that permit our clients to acquire, or secure tenure over, favourable sites prior to proclamation of a township or division of the land without contravening any of the provisions of the relevant property legislation.  

This has improved our clients' ability to negotiate the terms of acquisition and/or lease of portions of undivided land and also give our clients a competitive advantage when planning the development of their retail networks.
